Conditions: Hobbyshop Agnes

1. Applicability.
1.1 The acceptance of an offer or placing an order implies that the applicability of these Terms.
1.2 The provisions in these conditions can only be done in writing, in which case the remaining provisions shall remain in force.
1.3 All rights and claims, as in these conditions and any further agreements for Hobbyshop Agnes are stipulated, are also stipulated for by Hobbyshop Agnes intermediaries and other third parties.

2. Agreement
2.1 An agreement is only after acceptance of your order by Hobbyshop Agnes is entitled to refuse orders or attach certain conditions to the delivery, unless otherwise specified. If an order is not accepted, Hobbyshop Agnes this within ten (10) days after receipt of order.

3. Prices / Offers
3.1 All offers are without obligation and Hobby Shop Hobby Shop Agnes Agnes expressly reserves the right to change prices, especially when under (legal) regulations.
3.2 All prices are in euros including VAT and excluding shipping costs.

4. Payments
4.1 Payments are made through the facilities offered in the webshop.

5. Delivery
5.1 The Hobbyshop Agnes stated delivery times are indicative only. Late delivery does not entitle you to compensation nor the right to cancel your order or the agreement, unless the delay in delivery is such that you can not reasonably be expected that the agreement intact. You are then entitled to cancel the order or terminate the agreement where necessary.
5.2 The delivery of the products made at the time and place at which the products are ready for shipment.

6. Retention
6.1 The ownership of products is transferred only when all you under any agreement to Hobbyshop Agnes owe have met. The risk in respect of the products at the time of delivery to you.

7. Claims / Liability / Info Returns
7.1 You have the obligation to delivery to determine whether the products meet the agreement. If this is not the case, make Hobbyshop Agnes as soon as possible and in any event within three (3) days after delivery, at least reasonably possible after observation, writing and sufficient detail.
7.2 If it is demonstrated that the products do not meet the agreement, has Hobbyshop Agnes choose the products on their return to be replaced by new products or to refund the invoice value.
7.3 If you have a product for whatever reason do not wish to purchase, you have the right product within ten (10) days after delivery Hobbyshop Agnes to return. Returns are only accepted if the product and original packaging undamaged, also applies that the costs for returns are at your expense.
7.4 If you return items, follow these steps:
Send an e-mail to info @ Hobbyshop Agnes.com by reason of the return shipment and clearly state the order number. Pack the items so that damage is avoided.
7.5 Packages with damaged packaging so that it can reasonably be assumed that the content also has been damaged, and may be properly refused to accept. If in doubt about the content together with the delivery.

8. Electronic communications and evidence
8.1 For misunderstanding, delays or improper transmission of data and messages resulting from the use of Internet or other communication traffic between Client and Hobbyshop Agnes (or by Customer third parties) is Hobbyshop Agnes is not liable unless and insofar as there might be intentional or gross negligence on the part of Hobbyshop Agnes.
8.2 The administration of Hobbyshop Agnes count as conclusive evidence of the existence, content and implementation of the agreement with the Customer in any legal proceedings, until the contrary is proved by the party who relies on the fact that the evidence is not reliable .

9. Force Majeure
9.1 Without prejudice to its other rights, has Hobbyshop Agnes in case of force majeure the right, at its option, the execution of your order to suspend or terminate the agreement without judicial intervention, by informing you in writing to parts and without Hobbyshop Agnes held liable for any damages, unless under the circumstances to standards of reasonableness and fairness.
9.2 Force majeure shall mean any failure to Hobbyshop Agnes can be attributed, because it is not due to her fault and not under the law, legal act or generally accepted for its account.

10. Miscellaneous
10.1 If one or more provisions of these Terms or any other agreement with Hobbyshop Agnes is in conflict with any applicable provision, the provision will lapse and will be replaced by a Hobbyshop Agnes adopt new legally permissible similar provision.
10.2 Hobbyshop Agnes is competent in the execution of your order (s) to make use of third parties.

11. Applicable law and competent court
11.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, including these conditions, only Dutch law.
11.2 All disputes between parties will be submitted to the competent court in the Netherlands
